Noisy neighbours after buying property

I came across your website while looking into a problem I have with a recently purchased flat my partner and I bought in London. Since moving in we have had HUGE problems with noisy neighbours in the flat above us, up all night shouting music etc. I am feeling now that the seller of our property knew this to be a problem. The flat was empty for a long period of time and the seller was not in occupancy as far as I know. In the property disclosure form provided by our seller it states that he has never had any complaints/correspondence regarding noise to be a problem. In speaking to neighbours in other flats in our block I have learnt that the neighbours who are causing us a problem have been an ongoing cause of noise/nuisance for years. Is there any specific advice on a dispute of this nature or any action I could take against the seller as I’m sure he was aware of this issue even though he didn’t live in the property? Any advice would be welcome, thank you for your time.

I'm not an expert on legal issues such as this, but as far as I am aware, if you can prove that the seller was aware of the nuisance and then perhaps you have a legal case for compensation. Obviously I presume you have recently bought the flat and if so you should not delay in contacting a property solicitor if you want to be taken seriously. From what you say it appears you have a fairly good case. I'd suggest talking to a solicitor.
