Poor estate agent
We have had our house on sale for 14months & have just changed estate agents. The new agents we had round left copies of the contract for me to sign & return to them along with my ID which I did. They did not give me our copy; later that same day we received the draft flyer from them in the post, as the photos that were on the flyer were not the ones we wanted I called back into the office. They booked it into the diary for someone to call us on the Monday morning, which they didn’t. Also on reading the flyer more closely, we noticed 6 errors in the description of the property 2 of which were they were quoting that there was doubled glazed windows in 2 of the bedrooms, which they are not. In the letter that came with the flyers it had printed in bold print, that under the property Misdescritions act they could not commence with the marketing of our property until they had the flier back & signed by ourselves. So when they had not made any contact with us by the Wednesday evening we wrote to them to tell them not to continue the marketing of the property, Stating the number of errors we found on the flyer & the fact that they had not telephoned us. We then instructed another estate agent to act on our behalf. To our surprise last Friday the new agents telephoned us to ask why our property was being advertised with them & the previous agents. Spending over 2 hours on the phone to the other agents, all they would say to us is that they have a signed contract by us & they are holding us to this. Because we have no copy of the contact we cannot check any of the small print. Surely if they have published the original flyer that would be covered by The Property Misdescritions Act. Could you please help?
Do you know if the agent is a member of the Estate Agent’s ombudsman scheme? If so, you could complain to them - www.oea.co.uk If not, I’d suggest talking to a solicitor.
