We are in the process of selling our property and discovered that we did not have title to some of the land around our house, this resulted in us having to pay for an expensive land search to determine ownership. We now find ourselves having to buy the land from the local council in order to proceed with the sale. Should our solicitor have done a land search prior to agreeing to sell our property for us?
You will need to check the original conveyance to you which I am sure you are doing. See what land is conveyed with that contract. Perhaps another solicitor needs to get the title deeds back from the land registry.
If there is a mistake then perhaps its someones fault.
Obviously if someone else has been using the land as if it was theirs then that may cause a problem. Get legal advice.
